Issue occasion
The commemorative coin honors the protection of the rights of people with disabilities and their equal participation in society in Spain.
Background on the topic
The temporal reference is the United Nations Convention on the Rights of Persons with Disabilities (Übereinkommen der Vereinten Nationen über die Rechte von Menschen mit Behinderungen). The United Nations General Assembly adopted it on 13 December 2006; it entered into force internationally in 2008. The coin issue therefore falls in the year of the 20th anniversary of its adoption. Spain was among the first states to sign and ratify the Convention.
The Convention initiated a legal change of perspective. It does not understand disability solely as an individual health impairment. Disadvantages also arise from structural, communicative, legal and social barriers. The Convention therefore addresses, among other things, accessibility, independent living, education, employment, political participation and access to justice. States Parties must align their legislation accordingly and report regularly on its implementation.
In Spain, this issue also concerns the Constitution of 1978. Its original Article 49 used a designation that was later criticised as outdated and derogatory and was still strongly shaped by care, treatment and rehabilitation. At the beginning of 2024, the article was redrafted following many years of political and social debate. The current wording is based on the human-rights approach of the UN Convention. It also obliges the public authorities to remove barriers and to take into account the particular situation of women and minors with disabilities.
Representative organisations of persons affected were instrumental in preparing this reform. The process shows that this was not merely a change in wording, but the constitutional recognition of self-determination and accessibility. The coin thus commemorates both the anniversary of an international treaty and a more recent development in Spanish constitutional law. No historical person or individual building is the focus of this issue.
